Inkorporate needed our help in relation to a drinking vessel they had created on behalf of Absolut Elyx styled in the shape of a pineapple.
Since creating this bespoke piece for a marketing campaign our client discovered that the design was being replicated by other manufacturers. We advised Inkorporate on how to prevent the creation of low-quality copies and to protect the unique design from being used by others going forward.
As the product was being sold internationally, we worked alongside overseas lawyers to warn off the copycat versions and worked out where best to register design right protections.
Registering this as a design right was essential because it was the appearance of the vessel itself that needed to be protected. A design right gives you exclusive rights to this design and will stop anyone else from reproducing it.
The biggest market for the product was in Brazil and the US and so we prioritised those registrations before doing the same in the EU or UK.
